Overnight, a Colorado judge declined to block a subpoena issued by the Colorado Independent Ethics Commission to compel John Hickenlooper to testify in his ethics hearing later today. The DSCC had brought in Marc Elias to fight the subpoena, but the judge’s ruling against them means Hickenlooper must comply with the subpoena or risk contempt of court. Hickenlooper was opposing the subpoena based on the virtual format and “health guidelines” preventing him from being in the same room as his taxpayer-funded attorney. These “health guidelines,” however did not stop Hickenlooper from hosting a film crew at his home for his latest TV ad.

“John Hickenlooper has tried everything to avoid testifying today, including having the DSCC bring in their go-to legal henchman Marc Elias to back up the $525-an-hour lawyer taxpayers have been paying for out of a post-9/11 economic recovery fund,” said NRSC spokesperson Joanna Rodriguez. “He’s all out of tricks, and now it’s time for answers.”

If you’re just catching up on Hickenlooper’s violation of the Colorado gift ban due to his use of corporate-paid private jets and a Maserati limo while governor, you can read The Colorado Sun‘s “What you need to know… explained in 6 questions” here or watch the NRSC’s explainer video here.

The ethics hearing begins at 9am MDT. Details to watch are available here.
